About these terms
FlagSwing and flagswingpro.com are run by Flagswing Performance LLC, 8350 Bee Ridge Rd #283, Sarasota, FL 34241 (“FlagSwing”, “we”, “us”).
By placing an order, you agree to these terms and to our Shipping policy, Return and refund policy, Limited warranty and Privacy policy. You’ll be asked to accept these terms at checkout.
You must be at least 18 years old, or have a parent’s or guardian’s permission, to place an order.
Our products
- FlagSwing is a golf swing training aid, sold in packs of 2.
- We make our photos and descriptions as accurate as we can. Colors can look a little different on different screens.
- How much FlagSwing helps your game depends on your swing and your practice. We don’t promise a particular result.
- Use it as our setup guide shows. Make sure nobody is close by before you swing, and follow the rules of the course or range you’re on.
- FlagSwing has a pointed stake. Keep it away from young children.
Prices and pricing errors
- Prices are in US dollars and can change at any time. A change doesn’t affect orders already placed.
- Shipping costs are shown before you pay. Sales tax, where it applies, is calculated at checkout from your shipping address.
- Discount codes are limited to one per order, have no cash value, and follow the terms given with the code (for example, an expiry date).
- Pricing errors: mistakes happen. If a product is listed at the wrong price or with wrong information because of an error, we may cancel orders placed at that price, even after we’ve confirmed them, as long as they haven’t shipped. If we do, we’ll email you and refund you in full.
Orders
- Your order is placed when checkout is complete. We email you a confirmation with your order number.
- We may limit quantities, and we may decline or cancel an order, for example because of suspected fraud, a stock problem or a pricing error. If we cancel your order, we’ll refund you in full.
- Pre-orders: if a product is on pre-order, we show the date it will ship by. If that date has to change, we’ll email you before it passes with the new date and the option to cancel for a full refund.
Payment
Payments are processed by Stripe. We accept the payment methods shown at checkout, and you’re charged when you place your order. Stripe handles your card details; we never see or store your full card number.
Shipping
We ship to addresses in the United States. Delivery times, tracking and lost or damaged packages are covered in our Shipping policy.
Ownership of your order passes to you when we hand it to the carrier. If it’s lost or damaged on the way, we’ll make it right as our Shipping policy describes.
Cancellations, returns and refunds
You can cancel within 60 minutes of ordering, and return your order within 30 days of delivery. If you return it because you changed your mind, you pay to ship it back. The details are in our Return and refund policy.
Warranty
Every FlagSwing comes with our 90-day limited warranty against defects in materials and workmanship. Apart from that warranty and any rights the law gives you, we make no other promises about our products, to the extent the law allows. Any implied warranties last only as long as our limited warranty (90 days from delivery), as it explains.
Limits on our liability
To the fullest extent the law allows:
- we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your purchase or use of our products or our site; and
- our total liability for any claim about a product is limited to the amount you paid for that product.
Some states don’t allow these limits, so they may not apply to you. Nothing in these terms limits any liability that the law doesn’t allow us to limit.
Using our website
- The text, photos, videos, logos and designs on this site belong to FlagSwing or are used with permission. Please don’t copy them for commercial use without asking us first.
- Please don’t misuse the site: no automated bulk ordering, attempts to break or overload it, or fraud.
- Links to other sites, such as Stripe’s checkout page or carrier tracking, are covered by those sites’ own terms.
FlagSwing is patent pending.
Disputes and governing law
If something goes wrong, please contact us first at support@flagswingpro.com. Most problems can be sorted out quickly.
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute that we can’t resolve together will be handled by the state or federal courts serving Sarasota County, Florida, unless the law where you live gives you the right to bring it somewhere else. Either of us may also bring a claim in small claims court if it qualifies.
Changes to these terms
We may update these terms from time to time. The version shown when you place an order applies to that order.
Everything else
If a court finds part of these terms unenforceable, the rest still applies. These terms, together with the policies linked above, are the whole agreement between you and us about your purchase.
